Not in and of itself, Sylvia. Sometimes <noscript> is used for legitimate means. For example, HEDir might use it to present a static banner in place of the Google AdSense for non-JS users.
However, like a lot of things it tends to get abused and people use it to hide keywords and other content.
Basically, the rule of thumb I use is "if it's something you'd show the user, it's not spammy. If it's not something you'd show the user, then it is." _________________ HEDir's Prince of Cool

As I am helping visitlab these days, they are also using <noscript> tags for the browsers with JS disabled. This helps them track few PPC fraud clickers.
